Insurance
Civil liability

Any natural or legal person is liable to cause damage to a third party, whether by action, omission or negligence

The damage may entail criminal consequences, when the action, omission or negligence is classified as a crime, civil consequences when it is understood that it is not a crime, it is necessary to repair or replace the situation prior to the damage or both.

Civil liability is based on articles 1.902, 1.903 et seq. of the Civil Code:

Article 1.902 of the Civil Code establishes: “Anyone who by action or omission causes damage to another, through fault or negligence is obliged to repair the damage caused.”

Article 1.903 adds: “The obligation imposed by the previous article is enforceable, not only for one’s own acts or omissions, but also for those of those persons for whom one must be liable.

In the background, there is the underlying principle that in the event of damage caused and that must be repaired, the person who benefits from the existence of the work or service must be held accountable.

Civil liability insurance, like any insurance, consists of transferring the uncertainty of the cost that one or more damages caused to third parties may entail for the economy of a person, whether natural or legal, to a company in exchange for a known cost, the premium and up to the contracted limits.

In our opinion, civil liability insurance is of vital importance, in fact it is already mandatory in a multitude of activities, because unlike damage insurance, for example the all-risk insurance of a car, the consequences of a damage / claim are unforeseeable.

For this reason, EXTRA HOMES , whose administrator is FRICS by the prestigious institution, has contracted following the obligations set by it.

Plan de Compliance

Organic Law 5/2010, of 22 June, has made companies or corporations and societies in general liable to be criminally responsible for their activities and complements the usual legal requirements in the areas of labour, tax, and commercial law.

The new scenario of liability of legal persons contemplates criminal punishment against the legal person as a whole and its imputation for the crimes committed by its workers or representatives.

In fact, Article 31 bis, paragraph 1, of the Criminal Code details that legal persons shall be criminally liable:

Crimes committed in the name or on behalf of them, and for their benefit, by their legal representatives and administrators in fact or in law.

In the exercise of corporate activities and on behalf of and for the direct or indirect benefit of the legal entity.

And for having failed to comply with the duties of supervision, surveillance and control of their activity.

The law requires legal entities to implement criminal risk controls capable of guaranteeing their own self-control, based on the revision of codes of ethics and the implementation of “internal surveillance” systems or compliance programs.

"THE VALUE OF THE HUMAN BEING"

Author: Arab mathematician Al-Khawarizmi

“If it has ethics, then its value is =1. If it is also intelligent, add a zero and its value will be =10. If it is also rich, add another 0 and it will be =100. If above all that is also A beautiful person, add one more 0 and it equals = 1000. But, if he loses the 1, which corresponds to ethics, he will lose all his value because he will only have the zeros left. “
